To be technically and pedantically correct it isn't copyright, it's trademark, but also technically it is an infringement of a trademark. But for the reasons you mentioned we aren't going to get exercised over it.

I didn't know he passed. Nothing wrong with his grandson making a reproduction that matches the original if the original was damaged, or lost. As long as it isn't to be sold for profit.
